Please read these Terms of Service carefully before purchasing or using Zilch Mail. By using the software, you agree to be bound by these restrictions.
1. Proprietary & Closed-Source Software
Zilch Mail is a proprietary, closed-source commercial product. It is exclusively owned and operated by the Zilch Mail developers. Purchasing a license grants you a temporary, revocable right to use the desktop client and its supporting cloud services (licensing, notifications, usage metering).
Under no circumstances does your license grant you access to the underlying backend source code, the sending engine internals, or the proprietary infrastructure that powers it. You are strictly prohibited from attempting to reverse-engineer, decompile, instrument, trace, intercept, or bypass the authentication, licensing, send-quota, or any internal mechanisms of the Zilch Mail ecosystem.
2. Acceptable Use Policy & Legal Limits
Zilch Mail is a professional email sending tool built to help legitimate senders run cold outreach, transactional drips, and sequence-based follow-ups while maintaining sender reputation and respecting recipient consent. It is intended for use with email addresses you have a lawful basis to contact — addresses collected with explicit consent, your own user database, or addresses obtained through legitimate business channels.
You explicitly agree to use Zilch Mail in full compliance with all applicable anti-spam, data-protection, and electronic-communication laws, including but not limited to CAN-SPAM (US), CASL (Canada), GDPR (EU), and any equivalent regulation in your jurisdiction. You are solely responsible for ensuring you have the legal right to send mail to every recipient you import, that every message includes a clear and functional unsubscribe path, and that your SMTP credentials and sending domains are yours to use.
You may not use Zilch Mail to:
- Send unsolicited bulk email (spam), phishing, fraud, malware payloads, or any campaign that violates a recipient's consent or privacy.
- Send mail to recipients on lists obtained through scraping, theft, breach data, or any other unlawful means.
- Send through SMTP credentials or sending domains you do not own or are not authorized to use.
- Build, enrich, or validate lists intended for resale or downstream malicious use.
- Circumvent any provider's terms of service, sending limits, or anti-abuse measures.
3. Absolute Zero Developer Liability
DISCLAIMER OF LIABILITY: The developers, creators, and operators of Zilch Mail bear ABSOLUTELY NO LIABILITY for the actions, damages, or consequences resulting from the use or misuse of this software.
By using the software, communicating with its services, or sending any message through it, the End User assumes 100% of the legal, financial, and reputational responsibility for their actions. If you use Zilch Mail to facilitate spam, phishing, unauthorized mailing campaigns, IP / domain reputation damage to third parties, or any unlawful conduct, you act entirely on your own accord and the developers cannot and will not be held responsible.
Deliverability outcomes — inbox placement, open rates, click rates, bounce rates, complaint rates — are influenced by hundreds of factors outside Zilch Mail's control, including recipient mail server policy, your sending domain's reputation, your IP's reputation, content quality, list hygiene, and warm-up history. Zilch Mail provides the infrastructure to send; it does not and cannot guarantee where any individual message lands.
4. Prohibition on Resale and Redistribution
Your Zilch Mail license key and desktop client are strictly for individual or internal corporate use (if on a business plan). You may not under any circumstances:
- Resell, sublicense, rent, or lease the software or your license key to third parties.
- Wrap the software in a service of your own (SaaS, hosted mailer, third-party platform) and charge for access to its sending capabilities.
- Share your license key or account credentials on public forums, chat groups, or with unauthorized teams.
- Use a single license to send on behalf of multiple separate businesses or external clients.
Any license key found to be shared or abused will be permanently revoked immediately, without refund.
5. Refund Policy & Service Availability
Due to the digital and infrastructural nature of our proprietary cloud services, all sales are final and absolutely non-refundable. We do not offer prorated refunds for cancelled subscriptions.
Zilch Mail depends on continuous interaction with external SMTP providers, DNS, and mail-receiver infrastructure beyond our control. The software is therefore provided "AS-IS" and "AS-AVAILABLE". We do not guarantee uninterrupted delivery, inbox placement, or compatibility when third-party providers change their interfaces, anti-abuse measures, or policies. While we actively maintain and update the sending engine to keep pace with such changes, purchasing a license does not guarantee perpetual functionality against severe or sustained external disruptions.
